Compulsory Third Party (CTP) Insurance

Compulsory Third Party (CTP) personal injury insurance protects the at-fault owner or driver of a registered motor vehicle against compensation claims made against them by other people injured in a motor vehicle accident.

CTP insurance is mandatory for every registered motor vehicle in Australia and is included in your registration costs. It covers injury expenses and compensation, but it does not cover motor vehicle damage.

If you are the driver at-fault in an accident, and you are injured, you will not be covered by CTP Insurance.

The At Fault Driver Injury insurance policy is provided with CTP Insurance at no cost. It provides cover for at-fault drivers in certain circumstances and for specific amounts.

How to make a CTP personal injury claim

  1. Report the motor vehicle accident to police.
  2. Complete the ‘Notice of Accident Claim Form’.
  3. Return all documentation to RACQ Insurance.

1. Report the motor vehicle accident to police

We recommend you keep a written record of the:

  • police-issued Traffic Incident Number (TIN)
  • date your accident report was sent to police
  • name of the police staff you spoke to about the accident
  • name of the police station where you gave details of the accident

If your accident has not been reported to police you will need to complete a ‘Report of Accident to Police'. Send this form to the police station nearest to where the accident occurred.

2. Complete the ‘Notice of Accident Claim Form’

To make a claim, download a ‘Notice of Accident Claim Form’ from the Motor Accident Insurance Commission (MAIC). You will need to complete all sections before returning it to RACQ Insurance. This includes the medical certificate to be completed by your doctor.

The medical certificate provides an opportunity for your doctor to provide details of any rehabilitation/treatment needs you may have. It also gives an estimate of the length of treatment you may need.

3. Return all documentation to RACQ Insurance

Send the completed ‘Notice of Accident Claim Form’ (including medical certificate) to RACQ Insurance. Attach any additional documents, invoices or receipts related to the motor vehicle accident. Take care not to leave any sections blank as this could delay your claim.

When sending us your ‘Notice of Accident Claim Form’, make sure you provide the Traffic Incident Number (TIN) issued to you by the police. If no TIN was issued, you will need to attach a copy of the ‘Report of Traffic Incident to Police’.

Timeframes for CTP claims

You must send us the completed ‘Notice of Accident Claim Form’ (including medical certificate) within a set timeframe.

RACQ Insurance will need your claim within:

  • nine months of the motor vehicle accident, or
  • nine months of the first symptoms of an injury appearing, or
  • one month of your first consultation with a solicitor or lawyer

Within 14 days of receipt of your completed ‘Notice of Accident Claim Form’ (including medical certificate), RACQ Insurance will write to you acknowledging receipt and advising whether the claim form is complete. At the same time, RACQ Insurance will advise you whether we will fund the rehabilitation/treatment proposed by your doctor. This does not mean we admit liability.

Recovery from injury

If you incur any costs on your claim without approval from RACQ Insurance, you must not assume that you will be reimbursed. RACQ Insurance will only reimburse reasonable and appropriate claim-related expenses.

However, we will at all times comply with our statutory obligations under the Motor Accident Insurance Act, 1994. This includes the early provision of rehabilitation and the fast and efficient negotiation of claims settlements.

Settling a claim

It may be necessary for RACQ Insurance to write to your doctor(s), any other rehabilitation/treatment provider(s) and/or your employer(s). This is to gather the necessary information to make an accurate assessment of your claim.

RACQ Insurance will negotiate a settlement of your claim:

  • once your injury has stabilised to the point that an accurate assessment of the claim can be made, and
  • we have all the necessary information

The Queensland CTP scheme is fault based. The question of liability will be resolved in accordance with the Motor Accident Insurance Act, 1994.
