RACQ – Merchant Terms and Conditions
Samsung Pay is a mobile application with related services provided in Australia through Samsung Electronics Pty Ltd ACN 002 915 648 (Samsung
By uploading your RACQ member details to Samsung Pay and using your RACQ digital membership card via Samsung Pay (Membership Card
), you accept the following terms and agree to abide by them.
In these terms, RACQ means The Royal Automobile Club of Queensland Limited and its related bodies corporate (RACQ Group
) and the officers, agents, employees and contractors of the RACQ Group.
Relationship with Samsung
The use of Samsung Pay creates a relationship between you and Samsung, and RACQ is not responsible for, and accepts no liability in relation to, any loss, damage or claim that may be incurred by you as a result of your decision to use Samsung Pay or the Membership Card.
Your use of your Membership Card is subject to Samsung’s Terms of Service. You must become acquainted with those terms prior to using your Membership Card. RACQ does not accept any responsibility and is not liable for any third party conditions imposed in relation to the use of Samsung Pay or your Membership Card, or for the breach of those conditions by any person.
RACQ reserves the right to end its agreement with Samsung in relation to making the Membership Card available via Samsung Pay at any time without notice to you. If the agreement between RACQ and Samsung ends for any reason, you will no longer be able to use your Membership Card and RACQ is not responsible for, and accepts no liability in relation to, any loss you may incur as a result of your inability to use the Membership Card.
RACQ’s intellectual property
RACQ is the owner or the licensee of all intellectual property rights in the RACQ logos, designs, trade marks and business names used on your Membership Card. You must not use, modify or publish RACQ’s intellectual property without RACQ’s prior written consent, including for commercial purposes.
You must not allow another person to access and use your Membership Card.
You must comply with all applicable laws in your use of Samsung Pay and your Membership Card.
You must not misuse Samsung Pay or your Membership Card by knowingly introducing viruses or other malicious or technologically harmful material. You must not attempt to gain unauthorised access to RACQ’s website, servers, computers or databases.
If you no longer wish to use your Membership Card, you are responsible for following any instructions provided by Samsung in order to delete your Membership Card. RACQ does not manage, and has no control over, the deletion of your Membership Card or any information you upload to Samsung Pay.
If you breach these terms, then RACQ reserves the right to take any action deemed appropriate, including (without limitation):
(a) temporary or permanent withdrawal of your right to use the Membership Card;
(b) issuing a warning to you;
(c) instituting legal proceedings against you;
(d) disclosure of such information to law enforcement authorities as we reasonably feel is necessary; and
(e) taking any other action permissible under RACQ’s Constitution, By-laws, Membership Terms and applicable product terms.
RACQ excludes liability for actions taken in response to breaches of these terms or the spirit of these terms.

RACQ’s retail partners, offers and discounts may change at any time without notice. Access the RACQ Discounts app or visit racq.com/discounts
for the conditions, limits and exclusions for each offer.
The benefits and product discounts available to you may depend on the RACQ product you hold, your membership class and your membership tenure.
If your RACQ membership ends for any reason, you will no longer be entitled to use your Membership Card.
No warranty or liability
As Samsung Pay is provided and managed by Samsung, RACQ has no control over, and makes no guarantee, warranty or representation in relation to, the functionality, security, accuracy, content, availability, reliability, fitness for purpose, merchantability or non-infringement of Samsung Pay or your Membership Card or that they are free from harmful components or errors or are compatible with your device. To the extent permitted by law, RACQ:
(a) expressly excludes all conditions, warranties or other terms that may be implied by law; and
(b) accepts no responsibility for Samsung Pay or your Membership Card or for any loss or damage that may arise from the use, inability to use, or results of using Samsung Pay or your Membership Card by you or any other person, including direct and indirect or consequential loss or damage, even if foreseeable.
RACQ may in its absolute discretion amend these terms and conditions without notice.
These terms are governed by the laws of Queensland. You irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland, and the courts competent to hear and determine matters Queensland.
