New Queensland e-mobility laws: here’s what you need to know

New e-mobility laws came into effect across Queensland from July 1, bringing stricter rules for e-scooters, personal mobility devices (PMDs) and e-bikes.

The changes aim to improve safety on roads, footpaths and shared paths, respond to growing concerns about unsafe riding behaviour, and crack down on illegal devices.

Here’s a breakdown of the key changes and what they mean for Queenslanders

New speed limits for e-scooters and e-bikes

Speed limits have been tightened under the new laws, with different rules depending on where you ride.

  • 12km/h limit on footpaths and when passing pedestrians on shared paths
  • 25km/h maximum for all e-scooters and PMDs
  • E-bike motors limited to assisting the rider up to 25km/h (can go faster only with human pedal power)

Devices that can exceed the 25km/h limit are banned, meaning high-speed or modified devices are not allowed. These changes are designed to reduce the risk of serious injuries, particularly for pedestrians.

Tougher penalties and device confiscation

Penalties have increased for a range of offences. Higher fines now apply for:

  • Speeding
  • Not wearing a helmet
  • Careless riding
  • Carrying passengers illegally
  • Riding on prohibited roads

Police also have the power to seize and destroy illegal or non-compliant devices, including those that exceed speed limits or don’t meet regulations.

New compliance rules for e-bikes

E-bikes are also subject to tighter regulation, with mandatory compliance labelling required by 28 February 2027.

This will help ensure devices meet Australian safety standards and make it easier to identify legal and non-compliant e-bikes.

Drink riding laws for e-mobility devices

Police will conduct random breath testing, with a 0.05 BAC limit in place - the same as for motorists.

This means riders can face penalties for riding under the influence in public areas.

New age and licensing rules for riders

New eligibility rules will be introduced in stages.

From 1 July 2026:

  • Parents can be fined if children under 16 ride illegally

From 31 August 2026:

  • Riders must be at least 16 years old
  • Riders must hold a valid driver licence

There will be some exemptions for people unable to obtain a licence due to medical conditions or disabilities. How these exemptions will work in practice is still being determined by the Department of Transport and Main Roads.

Riders aged 12 to 15 will still be able to ride, but only under parental supervision.

Where you can ride

From 1 July 2026, riders will have expanded access to certain roads. E-devices can be ridden:

  • On roads with a speed limit of up to 60km/h
  • In on-road bike lanes

However, riders must still stick to the 25km/h device speed limit, unless a lower speed limit is signed.

As the new laws roll out, RACQ is encouraging all riders to familiarise themselves with the changes to stay safe, avoid fines, and support better behaviour across shared paths and public spaces.
